Colorado Revised Statutes, Title 35

Colorado has laws prohibiting the use of gestation crates, veal crates, and battery cages — as well a prohibition on the in-state sale of eggs from hens raised in extreme confinement such as conventional battery cages. 

In 2008, Colorado passed legislation to prohibit the use of veal crates by 2012 and gestation crates by 2018. The law requires that calves be able to stand up, lie down, and turn around without touching the sides of their enclosure. The law also requires that gestating sows be able to stand up, lie down, and turn around without touching the sides of their enclosure. Violation of the law is a class 2 misdemeanor and penalties range from three months imprisonment to 12 months imprisonment and a fine of up to $1000. 

In 2020, additional legislation was passed that protects egg-laying hens, and prohibits the in-state sale of eggs from caged birds. Colorado law currently requires that each hen be given one square foot of floor space, and an entirely cage-free housing system by January 1, 2025. From January 1, 2023 until January 1, 2025, egg-laying hens must have a minimum of one square foot of usable floor space per hen, which includes both ground space and elevated platforms, but does not include perches or ramps.

Starting January 1, 2025, all egg-laying hens must be housed in a cage-free housing system. For an enclosure with "unfettered access to vertical space", each hen must have a minimum of one square foot of usable floor space. For a system with no vertical access, like a single-level all-litter floor system, each hen must have one and a half square feet of usable floor space."

The sale of eggs from hens raised in cages is also banned in Colorado, regardless of where the eggs were produced.

Shell and Liquid EggsStarting January 1, 2022, shell eggs must come from housing systems that meet the requirements of the law. Under Question 3, Layers must have 1.5 square feet of usable floor space each. Under S2481, shell and liquid eggs must come from hens housed in systems that meet the United Egg Producers cage-free housing requirements.
